1. Acceptance of Terms

By accessing or using DA.N (“Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

DA.N is a domain lifecycle monitoring platform operated at domainsavailable.now. The Service provides:

  • Monitoring of domain status changes across the expiration pipeline
  • Enrichment with web archive history, DNS records, and AI content analysis
  • Search and filtering tools for discovering expired domains by niche
  • Optional auto-registration via your registrar API credentials

3. Beta / MVP Disclaimer

The Service is currently in beta / MVP stage and is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. The platform is under active development. Features may change, be added, or removed without prior notice. Data accuracy, uptime, and availability are not guaranteed. Use the Service at your own risk.

4. User Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. We are not liable for loss resulting from unauthorized use of your account.

5. Subscriptions and Payment

The Basic plan is €30/month. The Advanced plan is €50/month. All prices are in EUR plus applicable VAT. Subscriptions auto-renew monthly. You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months. Payments are processed securely via Stripe.

6. Acceptable Use & Fair Use

The Service is intended for personal use only. You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to reverse-engineer, scrape, crawl, or systematically copy the platform or its data
  • Redistribute, resell, sublicense, or commercially exploit DA.N data, domain listings, AI analysis results, or any other content provided by the Service without prior written consent from DA.N
  • Use the Service to harass, abuse, or harm others
  • Create multiple accounts to circumvent restrictions
  • Use automated tools to abuse the platform beyond authorized access
  • Access the Service via any means other than the provided web interface and authorized API endpoints

7. Data Ownership & Database Rights

All AI analysis results, enrichment data, scoring, categorization, search indexes, and any other content generated or aggregated by the Service are the exclusive property of DA.N. The database as a whole constitutes a protected compilation under EU Database Directive (96/9/EC) and applicable copyright laws.

Redistribution, reproduction, or systematic extraction of the DA.N database — in whole or in part — is strictly prohibited without prior written consent. This includes but is not limited to: scraping, bulk downloading, mirroring, or building derivative databases from DA.N data.

Raw factual domain data (names, expiration dates, lifecycle status) originates from multiple public and third-party sources. DA.N respects the terms of service of any upstream data provider and makes no claim of ownership over the underlying factual records. The protected compilation consists of the selection, arrangement, enrichment, and analysis performed by DA.N, not the factual data itself.

8. Rate Limiting

We reserve the right to impose rate limits on platform usage at our discretion. Exceeding rate limits may result in temporary or permanent restriction of access.

9. Domain Availability Disclaimer

We monitor domain availability, but we do not guarantee that any domain will be available for registration at the time you attempt to register it. Domain availability can change in seconds. We are not liable for missed registrations, incorrect status data, or delays in detection.

10. Auto-Registration

The auto-registration feature uses your registrar API credentials to submit standard registration requests on your behalf through the registrar's public API, subject to that registrar's rate limits, schedules, and API availability windows.

DA.N does not perform domain “catching”, “sniping”, or “snapping” and makes no attempt to compete with specialised drop-catching services. If a domain is caught by a faster third party before your registrar's API successfully processes the request, DA.N has no obligation or ability to intervene.

You are solely responsible for any domains registered through this feature and any associated costs. We are not responsible for registration failures, incorrect registrations, registrar downtime, rate limit throttling, or lost races to faster catching services. Auto-registration is a convenience tool — not a guarantee of successful registration.

11. Intellectual Property

The Service and its original content, features, functionality, and underlying technology are owned by DA.N and are protected by international copyright laws. You may not copy, modify, or distribute our content without explicit written permission.

12. Affiliate Links and Referrals

The Service contains affiliate and referral links to third-party services, including domain registrars. When you use these links, we may earn a commission at no additional cost to you. Affiliate relationships do not affect the accuracy of data provided by the Service. You are not obligated to use our affiliate links.

13. Limitation of Liability

You use the Service entirely at your own risk. To the maximum extent permitted by law, DA.N shall not be liable for any damages whatsoever arising from your use of the Service, including but not limited to loss of profits, data, domains, business opportunities, or any indirect, incidental, special, consequential, or punitive damages. We do not provide compensation or remedies for any issues, errors, data inaccuracies, or service interruptions.

If, notwithstanding the above, DA.N is found liable for any claim, our total liability shall not exceed the amount you paid for the Service in the preceding 1 (one) month.

14. Indemnification

You agree to indemnify and hold harmless DA.N and its operators from any claims, damages, and expenses arising from your use of the Service or violation of these Terms.

15. Termination

We reserve the right to suspend or terminate your account for violations of these Terms, at our discretion, with or without notice. You may delete your account at any time from your dashboard settings.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Estonia. The Service is operated by an EU-registered company. Any disputes arising from these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Estonia.

17. Changes to Terms

We may update these Terms. Continued use of the Service after changes constitutes acceptance. We will notify registered users of significant changes via email.
