1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding agreement between you and DA.N, operated by the entity named in Section 18, governing your access to and use of the website at domainsavailable.now and all related features (together, the “Service”). By creating an account or using the Service you confirm that you accept these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

2. Definitions

  • “Service” — the DA.N platform, website, dashboard, tools, and any APIs we make available.
  • “Account” — the registered user account through which you access the Service.
  • “Plan” — a subscription tier (Free, Lite, Basic, or Advanced) and any add-ons such as URL Packs.
  • “Content” — data, analysis, scoring, listings, and other materials provided through the Service.
  • “User Content” — data you submit or generate, including lists, saved searches, static site projects, and connected credentials.
  • “Registrar” — a third-party domain registrar whose API you connect to register or check domains.

3. Eligibility & Accounts

You must be at least 18 years old and able to enter into a binding contract to use the Service. You must provide accurate registration information and keep it current. You are responsible for all activity under your Account and for keeping your credentials secure. Notify us at [email protected] immediately of any unauthorised access. We are not liable for loss arising from unauthorised use of your Account that is not caused by us.

4. Description of Service

DA.N is a domain lifecycle monitoring platform. Depending on your Plan, the Service provides:

  • Monitoring of domain status changes across the expiration pipeline
  • Enrichment with web archive history, DNS records, and AI content analysis
  • Search and filtering tools for discovering expired domains by niche
  • Domain Monitoring and Domain Check batch tool (each up to 100 lists / 10,000 domains aggregate), available to all plans including Free
  • Optional auto-registration of dropping domains via your registrar API credentials, and one-click domain registration from search and browse results
  • Page Monitor — tracking and reporting of indexation status for sets of URLs against Google Search Console and Bing Webmaster (5,000 URLs included on Lite and above, expandable in 5,000-URL packs)
  • Optional integrations with Google Search Console, Google Analytics 4, Bing Webmaster Tools, and Cloudflare (analytics, log retrieval, DNS record management, IndexNow and Google Indexing API submissions)
  • 301 redirect rules for managing traffic from expired domains (Advanced plan and above)
  • CSV / JSON export of saved data (Advanced plan and above)

5. Beta / MVP Disclaimer

The Service is currently in beta / MVP stage and is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, to the extent permitted by law. The platform is under active development; features may change, be added, or removed without prior notice. Data accuracy, uptime, and availability are not guaranteed. Use the Service at your own risk.

6. Subscriptions, Billing & Taxes

The Free plan is €0/month. The Lite plan is €10/month. The Basic plan is €30/month. The Advanced plan is €50/month. The Page Monitor URL Pack is an optional add-on at €10/month per pack (each pack adds 5,000 monitored URLs and is stackable). All prices are in EUR and exclusive of VAT; applicable VAT is added at checkout based on your billing country. Payments are processed securely by Stripe; we do not store full card details.

Paid subscriptions auto-renew for successive monthly periods until cancelled. By subscribing you authorise us, through Stripe, to charge your payment method at the start of each billing period. URL Packs share the billing cycle with your Plan — they are prorated when added mid-cycle and cancelled together with the Plan on downgrade. If a payment fails, we may retry and may suspend or downgrade paid features until payment succeeds.

7. Cancellation & Refunds

You may cancel at any time from your dashboard. Cancellation stops future renewals; you keep access to paid features until the end of the current billing period, after which the Account reverts to the Free plan. Because the Service is a digital service supplied on a recurring basis and made available immediately, fees already charged for the current period are non-refundable and we do not refund partial months, except where a refund is required by applicable mandatory consumer law or expressly agreed by us in writing. If you believe you were charged in error, contact [email protected] and we will review it in good faith.

8. Acceptable Use & Prohibited Conduct

The Service is intended for your own use. You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable law
  • Reverse-engineer, scrape, crawl, or systematically copy the platform or its data
  • Redistribute, resell, sublicense, or commercially exploit DA.N data, domain listings, AI analysis results, or other Content without our prior written consent
  • Use the Service to harass, abuse, infringe, or harm others, or to register domains in bad faith or in violation of third-party rights
  • Create multiple accounts to circumvent limits, trials, or restrictions
  • Use automated tools to abuse the platform beyond authorised access, or interfere with its security or operation
  • Access the Service by any means other than the provided web interface and authorised API endpoints

We may impose and adjust rate limits at our discretion to protect the Service; exceeding them may lead to temporary or permanent restriction of access.

9. User Content & Responsibilities

You retain ownership of your User Content. You grant us a limited licence to host, process, and display it solely to operate and provide the Service to you. You are responsible for your User Content and for ensuring you have the rights to submit it, including any third-party credentials, sitemaps, or URLs you connect. You must not upload unlawful, infringing, or malicious content.

10. Intellectual Property & Database Rights

The Service and its original content, features, functionality, and underlying technology are owned by DA.N and protected by international copyright and other laws. All AI analysis results, enrichment data, scoring, categorisation, and search indexes are our property. The database as a whole constitutes a protected compilation under the EU Database Directive (96/9/EC) and applicable copyright laws.

Redistribution, reproduction, or systematic extraction of the DA.N database — in whole or in part — is strictly prohibited without prior written consent. This includes scraping, bulk downloading, mirroring, or building derivative databases from DA.N data.

Raw factual domain data (names, expiration dates, lifecycle status) originates from multiple public and third-party sources. DA.N respects the terms of any upstream data provider and makes no claim of ownership over the underlying factual records. The protected compilation consists of the selection, arrangement, enrichment, and analysis performed by DA.N, not the factual data itself.

11. Third-Party Services & Registrars

The Service integrates with third-party services (including Stripe, Google, Microsoft, Cloudflare, and domain registrars). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. When you connect a Registrar, you authorise the Service to act on your behalf through that Registrar's API, subject to its rate limits, schedules, and availability. You are responsible for compliance with each Registrar's terms and for all costs incurred through your Registrar accounts. Credential handling for connected services is described in the API Data Access Agreement.

12. Domain Availability Disclaimer

We monitor domain availability, but we do not guarantee that any domain will be available for registration at the time you attempt to register it. Domain availability can change in seconds. We are not liable for missed registrations, incorrect status data, or delays in detection.

13. Auto-Registration

The auto-registration feature uses your Registrar API credentials to submit standard registration requests on your behalf through the Registrar's public API, subject to that Registrar's rate limits, schedules, and API availability windows.

DA.N does not perform domain “catching”, “sniping”, or “snapping” and makes no attempt to compete with specialised drop-catching services. If a domain is caught by a faster third party before your Registrar's API successfully processes the request, DA.N has no obligation or ability to intervene.

You are solely responsible for any domains registered through this feature and any associated costs. We are not responsible for registration failures, incorrect registrations, registrar downtime, rate-limit throttling, or lost races to faster catching services. Auto-registration is a convenience tool — not a guarantee of successful registration.

14. Affiliate Links and Referrals

The Service contains affiliate and referral links to third-party services, including domain registrars. When you use these links, we may earn a commission at no additional cost to you. Affiliate relationships do not affect the accuracy of data provided by the Service, and you are not obligated to use our affiliate links.

15. Disclaimers & Warranties

To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any domain will be caught, available, or registrable. Nothing in these Terms excludes or limits any rights you have under mandatory consumer protection law that cannot lawfully be excluded.

16. Limitation of Liability

To the maximum extent permitted by law, DA.N shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, domains, goodwill, or business opportunities, arising from or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages.

Where liability cannot be excluded, our total aggregate liability for all claims arising out of or related to the Service shall not exceed the total amount you paid us for the Service in the one (1) month immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for any liability that cannot be limited under applicable law.

17. Indemnification

You agree to indemnify and hold harmless DA.N and its operators from any claims, damages, losses, liabilities, and reasonable expenses arising from your use of the Service, your User Content, your use of connected Registrar or third-party accounts, or your violation of these Terms or applicable law.

18. Suspension & Termination

We may suspend or terminate your access to the Service, in whole or in part, if you breach these Terms, if required by law, or to protect the Service or other users — with notice where reasonably practicable. You may stop using the Service and delete your Account at any time from your dashboard settings. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia and applicable European Union law, without regard to conflict-of-laws rules. The Service is operated by:

Any dispute arising from these Terms or the Service shall first be addressed through good-faith negotiation. If it cannot be resolved, it shall be subject to the exclusive jurisdiction of the courts of the Republic of Estonia. If you are a consumer resident in the EU, you may also have the right to bring proceedings in your country of residence and to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Mandatory consumer protections of your country of residence are not affected by this clause.

20. Changes to Terms

We may update these Terms from time to time. The “Last updated” date above reflects the current version, and we will notify registered users of material changes by email or a prominent notice. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
